Specifically, the applicants failed to initiate negotiations, did not notify the respondent of the intention to arbitrate, and did not involve the respondent in the appointment of the arbitrator as required by clause 25 of the employment contract. The arbitrator, Mr. Andole M. Christian, was not appointed in accordance with the contract, imposed himself as arbitrator, and acted in conflict of interest by also serving as advocate for the applicants.
