Ratio Decidendi

The court found that the cross-appeal was not defective or out of time, as it was filed before directions were given in the main appeal and the Respondent did not object at the appropriate stage. The typographical error in the date of judgment was deemed not to affect the substance of the appeal or prejudice the Respondent. On the issue of quantum, the court held that the award of Kshs 130,000 for general damages was not inordinately high or low, and there was no evidence that the trial magistrate applied wrong principles or misapprehended the evidence. Therefore, there was no basis for the appellate court to interfere with the award of damages.
