Ratio Decidendi

The court found that the Defendant's application for dismissal for want of prosecution was filed prematurely, as one year had not lapsed since the last court action on 20th August 2015. The application was filed on 16th June 2016, which was before the expiry of the requisite one-year period. Consequently, the statutory threshold for dismissal for want of prosecution under Order 17 Rule 2 of the Civil Procedure Rules had not been met. The court therefore dismissed the application with costs to the Plaintiff, without addressing the other issues raised by counsel.
