Procedural Posture

Succession Cause / Judgment

  1. 1 Whether the petitioner, as a married daughter allegedly born out of wedlock, is entitled to inherit from the deceased's estate under Kenyan law.
  2. 2 How the estate of the deceased should be distributed among the beneficiaries.

Ratio Decidendi

The court held that under the Law of Succession Act, all children of the deceased, including those born out of wedlock and married daughters, are entitled to inherit. The objector failed to provide evidence to support the claim that Bunyala customary law excludes married daughters from inheritance. The petitioner, being a child of the deceased's first wife, is a proper beneficiary. The court found the petitioner's claim to two acres reasonable, especially as it was supported by clan elders. The grant was confirmed, awarding the petitioner two acres from Bunyala/Sirigoi/119, with the remainder of the estate to be registered in the widow's name for further distribution among her children....

Court Disposition

Objection dismissed; grant confirmed; estate distributed as per judgment.

Orders

  • The grant of letters of administration intestate is confirmed.
  • The petitioner, Christine Makokha Waswa, to receive two (2) acres out of plot number Bunyala/Sirigoi/119.
