The High Court lacks jurisdiction to hear and determine appeals relating to ownership, occupation, or possession of land, as such matters fall exclusively within the mandate of the Environment and Land Court under Article 162(2)(b) of the Constitution and Section 13 of the Environment and Land Court Act. Any determination by the High Court on the merits of such an appeal would be ultra vires the Constitution. Consequently, the proper course is to transfer the appeal to the Environment and Land Court for hearing and determination.
