Ratio Decidendi

The High Court has jurisdiction under the Law of Succession Act to determine whether an administrator is entitled to indemnity from the estate for litigation costs incurred in the course of administering the estate. While the trial court in each suit determines who is to pay costs under Section 27 of the Civil Procedure Act, only the succession court can decide whether such costs are to be borne by the estate or personally by the administrator. The administrator is entitled to indemnity for costs properly incurred in suits prosecuted against third parties for the benefit of the estate and in her capacity as administrator.
