The court found that although the two suits arise from the same factual circumstances and share similarities, the prayers sought in each are distinct. The existence of allegations of fraud and the plea of constructive trust mean that the suit cannot be struck out summarily for want of privity of contract or as an abuse of court process. Section 3(3) of the Law of Contract Act does not bar the suit since constructive trust is pleaded, and the court must allow the plaintiff to ventilate his case fully, especially where fraud is alleged.
