The Court of Appeal found that the suit property was not family land but the personal property of the 1st respondent, inherited from his father. The evidence showed that the patriarch had allocated separate parcels to each of his sons, and the appellants’ parents had their own land. The special power of attorney given to the 1st appellant by the 1st respondent was explicit that the 1st respondent was pursuing the property in his own right, not on behalf of the family. The Minister’s Panel decision could not confer rights on persons who were not parties to the original adjudication dispute, and any such attempt was outside the Panel’s jurisdiction and thus void.
