  1. 1 Whether the claimant established that his termination was unfair.
  2. 2 Whether the claimant is entitled to unpaid wages for October 2013.
  3. 3 Whether the claimant is entitled to pay in lieu of notice and gratuity.

Ratio Decidendi

The court found that the claimant failed to lay any evidential foundation or meet even the low threshold required to establish that his termination was unfair. Without such a foundation, the court was not required to call upon the respondent to justify the termination. The evidence showed that the claimant had already been paid his October 2013 wages, pay in lieu of notice, and gratuity, as per the final dues schedule. The only relief available was for one day of wages worked in November 2013. All other claims, including compensation for unfair termination, were dismissed as the claimant did not prove unfairness in the termination process.

Court Disposition

Claim dismissed except for one day wage for November 2013; costs awarded to respondent.

Orders

  • The claimant is awarded wages for one day worked in November 2013.
  • All other claims are dismissed.
