The application was filed promptly, within a month of the judgment, satisfying the requirement of absence of unreasonable delay. While the appellant's offer of a motorbike as security was insufficient, the court exercised its discretion to require the appellant to deposit Kshs. 150,000 (the damages awarded) into court as security for due performance.
