Ratio Decidendi

The court found that the Claimant was employed for only about three months and was on probation. Under Section 45(3) of the Employment Act, 2007, he was not entitled to claim unfair termination. However, the Respondent failed to prove payment of the Claimant's November and December 2012 salaries. The court therefore awarded the Claimant salary for those two months, totaling KES 36,000, and ordered the Respondent to pay the costs of the suit. The issue of termination was rendered immaterial due to the statutory bar on probationary employees claiming unfair termination.
