Civil Appeal / Ruling on Application for Stay of Execution Pending Appeal

  1. 1 Whether the applicants have satisfied the conditions for grant of stay of execution pending appeal under Order 42 rule 6(2) of the Civil Procedure Rules, 2010.
  2. 2 Whether substantial loss will result to the applicants if stay is not granted.
  3. 3 Whether the application for stay was made without unreasonable delay.

Ratio Decidendi

The court found that the applicants faced the imminent threat of arrest and committal to civil jail, which would result in substantial loss that cannot be reversed. The application for stay was made promptly, without unreasonable delay. The applicants offered to provide security for the due performance of the decree. To balance the interests of both parties, the court allowed the application for stay of execution on condition that the decretal sum is deposited in a joint interest earning account of the parties' counsels or in court within 30 days.
