Ratio Decidendi

The High Court, having previously determined that it lacked original jurisdiction over the dispute and directed the matter to the Industrial Property Tribunal, cannot subsequently entertain or determine an application for dismissal for want of prosecution in the same suit. The court's lack of jurisdiction is not affected by the plaintiff's dissatisfaction or the filing of a notice of appeal; unless and until the appellate court overturns the jurisdictional ruling, the High Court remains without authority to make further orders in the matter. Therefore, the defendant's application for dismissal for want of prosecution is incompetent and must be struck out.
