The court held that it cannot alter or vary the substance of an arbitration award during enforcement proceedings. The issue of policy excess was canvassed before the arbitrator, who did not deduct it from the compensation and made no provision for set-off or counterclaim. The respondent, having failed to persuade the arbitrator to deduct the policy excess, cannot seek to re-open the issue at the enforcement stage. The court must enforce the award as rendered, including the full compensation and interest as awarded by the arbitrator. The respondent is therefore required to pay the full amount of the award without deducting the policy excess, and interest is payable as conceded.
