The court found that the Preliminary Objection on res judicata could not be sustained as it required ascertainment of facts from previous pleadings, which is not proper for a preliminary objection. On jurisdiction, the court determined that the cumulative value of the suit properties (Kshs. 12,200,000) and the outstanding loan balances (Kshs. 5,538,514.25) placed the matter within the pecuniary jurisdiction of the Chief Magistrate’s Court, not the High Court. Although the High Court has unlimited original jurisdiction, Section 11 of the Civil Procedure Act requires suits to be filed in the lowest competent court.
