As the endorsement had not occurred at the time the present suit was filed, the previous suit was still pending. However, the court found that the plaintiff acted in good faith, genuinely believing the withdrawal was effective upon filing. Despite this, the court determined that it would be just to stay the current proceedings until the plaintiff pays the costs in the previous suit, in accordance with Order 24 rule 4 of the Civil Procedure Rules.
