The court found that while the respondent was not a fare-paying passenger and thus not excluded from cover under S.5(b)(ii) of the Insurance (Motor Vehicle Third Party Risks) Act, the statutory limit of Kshs.3,000,000 imposed by S.5(b)(iv) applied. The trial magistrate erred in awarding the full sum of Kshs.9,548,757 against the insurer. The appellant is liable only up to Kshs.3,000,000 plus costs and interest. The court also noted procedural lapses by the appellant but did not find them sufficient to bar the appeal. The appeal succeeded only to the extent of limiting the insurer's liability to the statutory maximum.
