The appellate court found that the trial magistrate erred in adopting a multiplicand that included non-statutory deductions when calculating loss of dependency. The correct approach is to deduct only statutory deductions from the gross salary to arrive at the appropriate multiplicand. Applying this principle, the court enhanced the award for loss of dependency from Kshs. 294,248.40 to Kshs. 842,336.40. The court found no error in the awards for pain and suffering and loss of expectation of life, as these were in line with conventional sums and established legal principles.
