The Court found that the order of 16th March, 2009, merely dismissed the applicant's application to set aside an ex parte judgment and did not require any party to do or refrain from doing anything. As such, there was nothing to stay. Furthermore, the principal amount in dispute had already been settled, leaving only interest outstanding. The application for stay of execution was therefore without merit, as the requirements under Rule 5(2)(b) were not met and there was no executable order to stay. The application was dismissed with costs.
