Procedural Posture

Civil Appeal / Judgment

  1. 1 Whether the general damages awarded to the respondent were manifestly excessive given the injuries sustained.
  2. 2 Whether the trial magistrate properly considered relevant authorities and medical evidence in assessing damages.

Ratio Decidendi

The High Court found that the trial magistrate erred in failing to consider all relevant medical evidence, specifically a report by Dr. Joab Bodo, and that the award of KShs.750,000 in general damages was excessive given the nature of the respondent's injuries (a single fracture of the right ankle with varying assessments of permanent incapacity). The court held that, considering comparable awards in similar cases and inflationary trends, KShs.500,000 would have been sufficient compensation in 2017. The judgment of the lower court was set aside and substituted with an award of KShs.501,500 less 20% for the respondent's contribution to liability, resulting in a net award of KShs.401,200.
