The Defendant's allegations of defects were raised only after the threat of legal action and were not substantiated to the extent claimed. The court accepted that some minor defects existed, as admitted by the Plaintiff, and determined a reasonable deduction for remedial works at Kshs. 185,304, being 50% of the Defendant's claimed amount, to account for both parties' positions.
