The Court of Appeal held that the application of Islamic law to exclude the appellants—children of a Muslim father and a non-Muslim mother, who do not profess the Islamic faith and have not submitted to the jurisdiction of the Kadhi's court—from inheriting their father's estate is not permissible under the Constitution. Article 24(4) and Article 170(5) of the Constitution strictly limit the application of Muslim law to cases where all parties are Muslims and have submitted to the Kadhi's court.
