The issue of her entitlement as a beneficiary was neither raised nor determined in the ruling of 31st January 2022. The court held that an error apparent must be self-evident and not require elaborate argument or reasoning. Since the mother’s entitlement would require substantive argument and was not a clear omission, the application for review did not meet the threshold for review under Order 45 of the Civil Procedure Rules. The application was therefore dismissed for lack of merit.
