The court held that it lacked jurisdiction to entertain the petition, as the dispute concerned the nomination and gazettement of members to the County Assembly via party lists, which, upon gazettement, constitutes an election. Any challenge to such an election must be brought by way of an election petition before the designated election court, not by constitutional petition in the High Court. The court relied on the Supreme Court's decision in Moses Mwicigi & 14 others v IEBC, which clarified that the process of nomination and gazettement is an integral part of the election process, and once gazettement occurs, the IEBC's mandate ends and any disputes must be resolved by election courts....
