Ratio Decidendi

The court held that the affirmation of P.W.7 was valid under Section 15 of the Oaths and Statutory Declarations Act, as affirmation and oath have the same legal effect. The absence of a Koran did not invalidate the affirmation. Furthermore, the production of witness statements by P.W.7, who recorded them, was proper, especially as the witnesses had been declared hostile and the prosecution had the right to cross-examine them. At this interlocutory stage, no prejudice was found to have been suffered by the applicant. The application for conservatory orders was therefore dismissed, and the trial was ordered to proceed to conclusion.
