Procedural Posture

Civil Case / Ruling on Notice of Motion to Discharge or Vary Injunction

  1. 1 Whether the defendant properly served the plaintiff with a statutory notice as required under the charge and the Registered Land Act.
  2. 2 Whether the injunction restraining the exercise of the statutory power of sale should be discharged or varied.

Ratio Decidendi

The court found that the defendant failed to provide a satisfactory explanation for not serving the statutory notice to the plaintiff at the address provided in the charge or at other known addresses. Given the previous finding that no notice had been given to the plaintiff and the lack of evidence of proper service, the court was left in doubt as to whether the notice was ever served and received by the plaintiff. Since the burden of proof of service lies with the defendant, the benefit of doubt was given to the plaintiff. Consequently, the application to discharge or vary the injunction failed.
