Ratio Decidendi

The court found that the respondent failed to prove the genuineness of the alleged redundancy and did not comply with the mandatory procedures under Sections 40 and 43 of the Employment Act, 2007. The claimants were not given proper notice or a hearing, and the respondent did not demonstrate that the positions held by the claimants were abolished. The court held that the termination was unfair.
