Procedural Posture

Land and Property Suit / Judgment

  1. 1 Whether the Plaintiffs have locus standi to institute the suit.
  2. 2 Whether the Defendants fraudulently sub-divided land parcel number CENTRAL KITUTU/MWONYERERO/178 and obtained titles in respect of CENTRAL KITUTU/MWONYERERO/1822 and 1823.
  3. 3 Whether the Plaintiffs are entitled to the reliefs sought.

Ratio Decidendi

The Plaintiffs lacked locus standi to institute the suit as they had not obtained Letters of Administration in respect of the estate of the deceased, Benson Mageto Omariba. The law requires that only a legal representative with a grant of letters of administration can bring an action concerning the estate of a deceased person. The Plaintiffs, being mere sons of the deceased, did not have the requisite capacity to sue. Even if locus standi were assumed, the Plaintiffs failed to prove fraud against the Defendants to the required standard. Allegations of fraud must be specifically pleaded and strictly proved, which the Plaintiffs did not do. Consequently, the Plaintiffs’ suit was dismissed...

Court Disposition

Plaintiffs' suit dismissed; Defendants' counterclaim allowed.
