Ratio Decidendi

The court found that while there was a valid reason for the Claimant's termination due to the admitted wrongful posting of funds, the Respondent failed to follow due process as required by law. The disciplinary hearing was convened in a hurried and procedurally unfair manner, denying the Claimant adequate time and information to prepare a defense. The lack of proper notice and opportunity to be heard rendered the dismissal unfair under Section 45(2)(c) of the Employment Act. Consequently, the court held that the dismissal was unfair and unjustified in procedure, entitling the Claimant to compensation and other remedies despite the existence of a valid substantive reason for termination.
