The court found that the appellants failed to adduce any evidence to support their allegations of contributory negligence by the respondent. The respondent's testimony that he was standing off the road when struck by the appellant's vehicle was uncontroverted. The appellants did not challenge the production of key documents as exhibits during trial, and thus could not raise the issue on appeal. The 1st appellant, as the driver, was wholly liable for the accident, and the 2nd appellant, as the registered owner, was vicariously liable. On quantum, the court held that the trial court's award for pain and suffering was excessive compared to comparable cases and reduced it to Kshs.2,000,000....
