The court found that the dismissal of the plaintiff's suit for want of prosecution was irregular because no written notice to show cause was issued or served on the plaintiff as required by Order 17 Rule 2(1) of the Civil Procedure Rules. The court held that, notwithstanding the absence of an express provision for setting aside such an order, it retains inherent jurisdiction to do so in the interests of justice. Although the reasons advanced by the plaintiff for the delay in prosecution were not entirely satisfactory, the court noted that the defendants had not demonstrated any prejudice suffered as a result of the delay, and that a pending application to strike out the suit remained...
