The court held that in medical negligence claims, the cause of action does not necessarily accrue on the date of the alleged negligent act but may accrue when the plaintiff discovers or ought to have discovered the injury. In this case, the plaintiff only became aware of the alleged negligence on June 24, 2017, when he learned he was not HIV positive after a subsequent test at a different hospital. Therefore, the limitation period began to run from that date. Since the suit was filed on or about March 26, 2019, it was within the three-year statutory period under Section 4(2) of the Limitation of Actions Act.
