The court found that as at the time of the ruling on 15th February, 2017, the appellant had already paid the sum of Kshs. 1,950,380/- to the respondent in compliance with the garnishee order absolute. Although the garnishee order absolute was later set aside, the payment had already been made, and there was no application before the trial magistrate for a refund. The trial magistrate therefore had nothing left to determine regarding the applications for payment, and the decision not to order a refund or revisit the payment was proper.
