The court further held that no prejudice would be suffered by the respondent that could not be compensated by costs. On the issue of stay of execution, the court was satisfied that substantial loss may result to the applicant if stay was not granted, given the substantial sums involved and the risk that the respondent may not be able to refund the amounts if the appeal succeeded.
