Procedural Posture

Petition of Appeal / Ruling on Preliminary Objections

  1. 1 Does the Supreme Court have jurisdiction to hear the appeal under Article 163(4)(a) of the Constitution as a matter involving interpretation or application of the Constitution?
  2. 2 Did the lower courts address any constitutional issues warranting an appeal as of right to the Supreme Court?
  3. 3 Should the Petition of Appeal be struck out for want of jurisdiction?

Ratio Decidendi

The Supreme Court held that its jurisdiction is strictly circumscribed by the Constitution and is not available as of right unless the appeal involves the interpretation or application of the Constitution, or raises a matter of general public importance. The Court found that neither the High Court nor the Court of Appeal addressed any constitutional issues, and the Appellant failed to specify the jurisdiction invoked. The dispute was determined on contractual and statutory grounds, not constitutional ones. Therefore, the appeal did not meet the threshold for the Supreme Court's jurisdiction under Article 163(4)(a), rendering the Petition of Appeal incompetent and liable to be struck out....

Court Disposition

Petition of Appeal struck out for want of jurisdiction; preliminary objections upheld; costs awarded to Respondents.

Orders

  • The Preliminary Objections by the 1st, 2nd and 3rd Respondents are upheld.
  • The Petition of Appeal is struck off.
