Ratio Decidendi

The court found that there was a mistake apparent on the face of the record regarding the calculation of accrued leave days. The award for accrued leave was based on an incorrect figure of Ksh.210,000, whereas the correct calculation for 68 leave days amounted to Ksh.79,356. The court therefore reviewed and reduced the award for accrued leave accordingly. However, the court held that the award of 10 months’ salary as compensation was within the statutory maximum of 12 months and did not constitute an error or excess. The application for review was allowed only to the extent of correcting the leave days award, with the rest of the judgment remaining undisturbed.
