Ratio Decidendi

The High Court lacks jurisdiction to grant leave to appeal to the Court of Appeal against its own decision on an arbitral award under the Arbitration Act. Section 39(3) of the Arbitration Act expressly provides that such leave must be sought from the Court of Appeal, not the High Court. The Arbitration Act is a self-contained code, and the Civil Procedure Act and Rules do not apply to arbitral proceedings unless specifically provided. The application for leave to appeal, having been brought under the Civil Procedure Act and Rules, is misconceived and without merit. Accordingly, the application is dismissed for want of jurisdiction and merit.
