Procedural Posture

Civil Appeal / Stay Application Ruling

  1. 1 Whether the applicant has satisfied the conditions for grant of stay of execution pending appeal under Order 42 rule 6(2) of the Civil Procedure Rules.
  2. 2 Whether the applicant will suffer substantial loss if stay is not granted.
  3. 3 Whether the applicant has provided adequate security for the due performance of the decree.

Ratio Decidendi

The court found that the applicant had demonstrated a reasonable apprehension that the respondents, as legal representatives of the estate of the deceased, may not be able to refund the decretal sum if the appeal succeeds, and the respondents had not provided evidence of their ability to do so. The application for stay was made without unreasonable delay, and the applicant expressed willingness to provide security. Balancing the interests of both parties, the court granted stay of execution on condition that the entire decretal sum be deposited in a joint interest-earning bank account or in court within 30 days.
