Ratio Decidendi

The court found that the identification evidence was insufficient to sustain a conviction. There was no evidence that the complainant or other witnesses gave a description of the assailants to the police in their initial report, which is a critical safeguard against mistaken identity. The identification parade, though properly conducted, was rendered ineffective in the absence of such prior description. Additionally, the court noted that the arresting officer did not provide a basis for the arrest, and the trial court failed to adequately consider the appellants' defence. As a result, the conviction was deemed unsafe and could not be sustained.
