Ratio Decidendi

The court held that the substance of the dispute was a work injury sustained by the respondent in the course of employment with the appellant. Under Article 162(2) of the Constitution and section 12 of the Employment & Labour Relations Court Act, the Employment and Labour Relations Court (ELRC) has exclusive jurisdiction to hear and determine disputes relating to employment and labour relations, including work injury claims. Section 87 of the Employment Act further bars any court other than the ELRC from determining such disputes. The High Court, therefore, lacks jurisdiction to entertain the appeal. The proper forum for the appeal is the ELRC, a court of equal status to the High Court....
