There was no evidence presented to show that the director had exceeded his powers or lacked authority. The case relied upon by the plaintiff was distinguishable as it concerned an employee, not a director. Therefore, the preliminary objection that the affidavit was incompetent for lack of express authorization was not sustained. The objection was dismissed with costs to the objector.
