Ratio Decidendi

The High Court held that the Resident Magistrate's Court was limited by statute to a monetary jurisdiction of Ksh 500,000/=. Since the subject matter of the suit was Ksh 926,000/=, the court lacked jurisdiction to entertain any application, including one for amendment of the Plaint. Jurisdiction is fundamental and cannot be conferred by the nature of the application or by consent of the parties. Any proceedings or rulings made without jurisdiction are null and void. The ruling of the Resident Magistrate was therefore incompetent and was set aside. The matter was directed to be mentioned before the Chief Magistrate for allocation, unless the jurisdiction had been appropriately increased.
