The Court of Appeal held that the appellant failed to comply with the mandatory notice requirements under section 42(1) of the East African Community Customs Management Act, as amended. The law required publication of the auction notice in both the Official Gazette of the East African Community and in the gazette or a newspaper of wide circulation in the partner state where the owner of the goods is domiciled. In this case, the only publication was in the Kenya Gazette, which was insufficient to notify the 1st respondent, a Ugandan company.
