The Court of Appeal found that the applicants had demonstrated an arguable appeal, particularly on the issues of whether the government was properly held liable for the respondents' losses and whether special damages were adequately pleaded and proved. The Court further held that the quantum of the judgment was substantial and that, given the respondents' foreign status, there was a real risk that the government would be unable to recover the sums if the appeal succeeded and the money had already been paid out.
