The court found that the Preliminary Objection raised by the Respondent was not properly grounded as it required the ascertainment of contested facts, contrary to the principles set out in Mukisa Biscuit. The Respondent's objection did not assume the truth of the Appellant's pleaded facts and introduced new facts that were disputed. Furthermore, the lower court erred in its factual analysis by failing to recognize that the payment terms in the Local Purchase Orders specified payment sixty days after certified delivery, with the confirmation certificate dated 21st April 2016. Therefore, the cause of action accrued on 20th June 2016, making the Statement of Claim filed on 22nd April 2022...
