Ratio Decidendi

The Tribunal found that although the draft defence was not on record in the initial application, the claimant's own affidavits acknowledged its existence and challenged its contents. Upon perusal, the Tribunal determined that the draft defence did not consist of mere denials and contained substantive issues. In the interest of justice, and to allow both parties to be heard on merit, the Tribunal exercised its discretion to set aside the orders of 27.5.2021, stay the proclamation notice, and grant the respondent leave to file a defence. The Tribunal emphasized that justice is best served by allowing the respondent to present his case rather than disposing of the matter on technicalities.
