Although the respondent breached the contract by harvesting the cane outside the stipulated period, the appellant failed to prove any actual loss resulting from the breach. The evidence showed that the appellant was paid amounts for the 1st and 2nd ratoon crops that exceeded the value assessed by her own expert. As a result, the court found that the appellant did not suffer any compensable loss and was not entitled to damages, notwithstanding the technical breach. The appeal was therefore dismissed, affirming the trial court's finding that the claim had been settled by payment for the harvested cane.
