The evidence showed that a confirmed grant had been issued to the 3rd Defendant, authorizing him to inherit the suit land, and the transfer to the 1st and 2nd Defendants was effected by a third party, Silvanus Onyiego Nyawaga, who was not joined in the proceedings. The Plaintiffs did not demonstrate what irreparable harm they would suffer if the injunction was not granted, and the balance of convenience did not favour the issuance of the order.
