The 1st respondent lacked locus standi to challenge the appellant's statutory power of sale, not being the registered proprietor of the charged property or privy to the lending contract. Furthermore, the abatement of the suit against the deceased chargor extinguished the 1st respondent's claim against all other defendants, as the claim was dependent on the deceased's liability.
