The court found that the Special National Delegates Conference held on 6th July, 2018 was convened in violation of the Kenya County Government Workers Union constitution. The notice issued by Cornel Mabatsi was not authorized by the National Executive Committee, did not meet the quorum requirements, and was based on a misinterpretation of a prior court ruling (Nakuru Cause No.112 of 2018), which did not authorize such a meeting. The Labour Relations Act and the union constitution require strict compliance for the convening of such meetings and for the registration of changes in union officials.
